Delhi Gang Rape Update: Court issues summons to the Accused

Metropolitan Magistrate Namrata Aggarwal took cognisance of the chargesheet filed by the Delhi Police in the gang rape of the para medical student. The Metropolitan Magistrate also issued production warrants to the five accused in the Delhi gang rape case to appear before the Court on January 7. Ram Singh, Mukesh, Pawan Gupta, Vinay Sharma and Akshay Thakur are the five accused who would be produced before the Court on January 7. The sixth accused, who is a juvenile, will be produced before the Juvenile Justice Board on the same day.



"I have perused the chargesheet and other documents. Prima facie offence under Sections 302 (murder), 307 (attempt to murder), 376 (2)(g) (gang-rape), 377 (unnatural offences), 395 (dacoity), 396 (murder in dacoity), 394 (hurting in dacoity), 201 (destruction of evidence), 120B (conspiracy), 34 (common intention) and 412 (dishonestly receiving stolen property) of the IPC is made out against all the accused. I take cognisance of the chargesheet and issue summons /production warrants to all the five accused for January 7,” said the Metropolitan Magistrate.



The chargesheet, running up to 1,000 pages, was filed by the Delhi Police on January 3, 2013. The matter is expected to be transferred to the Fast Track Court set up to deal with matters relating to crimes against women. Additional Sessions Judge Yogesh Khanna shall be hearing the matter in the Fast Track Court. Saket Bar Association, however, continued to remain firm on its appeal to the lawyers to not extend legal help to the accused.



Meanwhile, there was unexpected excitement in the court room when a man demanded that the details of the victim be made public and the copies of the charge sheet be supplied to the media. The said demand was made by one Swamy Om Ji. When his locus was questioned by the prosecution, he shot back saying that it was his right as a citizen of India. The Magistrate, however, asked him to approach the Sessions Court.
